1. Contractual Relationship

2. The Services
The Services consist of an online platform allowing users to browse, order, and arrange delivery or pickup of food products provided by independent third-party vendors partnered with Biedronka (“Third Party Vendors”). Unless otherwise agreed, Services are provided for your personal, non-commercial use only. Biedronka does not itself provide food or delivery services but facilitates orders between you and the Third Party Vendors.
License.
Subject to these Terms, Biedronka grants you a limited, non-exclusive, revocable license to use the Services on your personal device solely for personal use. All other rights remain with Biedronka or its licensors.
Restrictions.
You may not copy, modify, distribute, reverse engineer, or misuse the Services in any unauthorized manner.
Third Party Content.
The Services may include third-party content and advertisements beyond Biedronka’s control. Different terms or policies may apply. Biedronka does not endorse third-party providers and disclaims liability for their products or services.
Ownership.
All intellectual property rights in the Services remain with Biedronka or its licensors. You may not use Biedronka’s trademarks or logos without permission.
3. Your Use of the Services
User Accounts.
You must register for an account to place orders, providing accurate personal details and a valid payment method. Account security is your responsibility. You must be at least 18 years old to register.
User Conduct.
You agree to use the Services lawfully and not misuse accounts or services. Minors under 18 cannot use the Services independently.
Text Messages.
By registering, you consent to receive SMS notifications related to your orders. You may opt out, but this may affect service functionality.
Promotional Offers.
Biedronka may issue promotional codes with specific terms. Codes must be used fairly and lawfully. Misuse may result in revocation or account termination.
User Content.
You may submit feedback or other content, granting Biedronka a worldwide license to use it for service improvement and promotion. You represent that your content does not infringe third-party rights or violate laws.
4. Payment
You agree to pay the price for goods or services ordered via the platform. Biedronka processes payments on behalf of third-party vendors. Prices include applicable taxes. Payments are final unless otherwise specified.
You authorize Biedronka to charge your chosen payment method. If the primary method fails, backup methods on file may be used.
Cancellation fees may apply if you cancel orders after processing.
Gratuities for delivery personnel or vendors are voluntary.
5. Disclaimers; Limitation of Liability; Indemnity
Disclaimer.
The Services are provided “as is.” Biedronka disclaims warranties regarding accuracy, availability, or quality of third-party vendors and deliveries.
Limitation of Liability.
Biedronka is not liable for indirect damages or losses arising from your use of the Services or dealings with vendors. Total liability is limited to €500 or equivalent.
Indemnity.
You agree to indemnify Biedronka against claims related to your use of the Services or breach of these Terms.
6. Governing Law; Dispute Resolution
These Terms are governed by Polish law. Disputes shall first be submitted to mediation under the International Chamber of Commerce rules. If unresolved in 60 days, disputes will be resolved by arbitration in Warsaw, Poland, in English.
7. Other Provisions
Notices.
Biedronka may notify you via the Services, email, or postal mail.
Assignment.
You may not assign your rights without consent. Biedronka may assign these Terms in connection with business transfers.
If any provision is invalid, the remainder shall remain in force.
These Terms constitute the entire agreement between you and Biedronka regarding the Services.
